The ODNI General Counsel bringing the Director a whistleblower complaint alleging that intelligence reporting contradicted Dr. Fauci’s testimony to Congress about gain-of-function research at the Wuhan Institute of Virology — and proposing how to handle it.

The complaint alleges there is intelligence reporting contradicting Dr. Fauci’s testimony that no gain-of-function research occurred — or at least was not paid for by NIH — at WIV.

The Acting IC Inspector General could not conclude that the cited reporting contradicted the testimony, and the General Counsel notes his understanding that there is substantial disagreement within the scientific community about what even constitutes gain-of-function research.

Nonetheless, given that the complaint is classified, his view is that it should be provided to the congressional intelligence committees.

The proposal at this stage: have the Acting IC IG transmit the complaint to HHS’s Inspector General, with ODNI committing to ensure that official has access to the intelligence needed to review it, and inform Congress simultaneously.

The covering note is unusually human — "Given everything that’s going on, I’m sure this is the last thing that you want to deal with." It was sent the day after the fall of Kabul.
